Some form of conflict or disagreement is almost inevitable in certain contexts. But leveraging the law provides numerous avenues for resolution. Understanding the mechanisms such as mediation, arbitration, and litigation (when necessary) allows individuals to choose appropriate paths for resolving disputes. Each method has its benefits and applicability depending on the situation. Knowing all these, and how to potentially leverage each can help in effectively navigating possible conflicts.

Embracing Change: Law as an Evolving Entity

For example, the current (conservative) majority in Justice Robert's US Supreme Court (PREDICTABLY, OVER THE COURSE OF MULTIPLE DECISIONS), finally did away with the few remaining ("equalizing") rights and protections previously canonized (since the mid 1960s) and generally acknowledged since then as a step forward in the nation's match towards a more equal, inclusive and fair society. An awareness of these kinds of MONUMENTAL SHIFTS IN WHAT THE LAW IS will keep you ahead and ensure that you remain compliant with such pertinent legal developments as they may directly or indirectly impact you, your business ventures, or other interests.

A BRIEF EDITORIAL NOTE BEFORE I CLOSE.

While by no means perfect, American democracy and FREE enterprise have been key to the country's growth and positive trajectory since its inception 250 years ago.

Based on any coherent philosophical analysis on a credible THEORY OF JUSTICE, Capitalism, by its very nature, and also given the implicit social contract of equality underpinning the nation's constitution), society recognizes and makes some allowances to ameliorate some of the potential negative impacts of CAPITALISM and melds it seamlessly into our great economic system without individuals who may from time to time be negatively impacted by the rigors of capitalism, routinely carrying pitch-forks and assaulting the capitol claiming REVERSE DISCRIMINATION (especially given all the TAX BREAKS AND OTHER BENEFITS HANDED BY POLITICIANS TO MANY PRIVATELY OWNED BUSINESSES -ALL ON THE PUBLIC DIME)!!!

Goes without saying- No one should be discriminated against, regardless of gender, race, religion, color, sexual orientation, etc. It is however disingenuous to suggest that any effort to CORRECT HISTORICAL AND STILL EXISTING SYSTEMIC DISCRIMINATION AND EXCLUSION, even if less overt, (by putting policies in place to partially alleviate over time, SOME of the vestiges of historical exclusion, slavery, Jim Crow Laws, and hate against MILLIONS OF OTHER GROUPS OF CITIZENS), amounts to REVERSE RACISM. Especially when the goal is clearly not to oppress or dominate anyone, much less do so based on race, gender, etc.

Those laws and policies (now deemed by the US SUPREME COURT AS NO LONGER PERMISSIBLE) were SOLELY to partially uplift and give almost equal opportunities to the previously excluded or disadvantaged millions of ostensibly equal citizens.

Obviously, sometimes unavoidably, some INDIVIDUALS may be negatively impacted on a random basis during any effort to open up a little figurative space of inclusion into the company of those ALREADY accorded equal opportunity and a consistently DIGNIFIED TREATMENT as citizens worthy of EQUAL CARE AND CONCERN.

Any good faith effort to claw-back a little space of inclusion and equal OPPORTUNITY for a previously excluded (and still severely impacted GROUP) would, of necessity, engender some modest, random, and narrow negative outcomes for some clearly untargeted individuals, including those in the historically well-advantaged and still very much protected majority.

Notably, this surgical social engineering with the sole goal of partially rectifying ACTUAL WRONGS INFLICTED ON OTHER CITIZENS, is on balance less negatively impactful on society than the unearned financial advantages and windfall society already makes for some private business. As a matter of POLICY, society has determined that while there are some attendant negative consequences, on balance, some selectively favored-industry approach to the operation of free enterprise in our society, will be more beneficial for the greater good than not. Yet some continue to act shocked when previously excluded groups are being offered opportunity, NOT TO GET A LEG UP AGAISNT SOME ALREADY ADVANTAGED GROUPS IN SOCIETY, but merely to get A CHANCE AT A SLIGHTLY MORE EVEN PLAYING FIELD! Yet, some see that as the end of America! WHICH VERSION EXACTLY?

It needs to be said again and again with pride that MILLIONS, including the ENSLAVED ANCESTORS of many CURRENTLY LIVING AMERICANS labored and suffered without compensation for their undeniable contribution to the building of this GREAT COUNTRY. Millions of THE ANCESTORS (including millions) of current beneficiaries of AMERICA'S GREATNESS who came from other continents OUTSIDE OF AFRICA, came AFTER, and BENEFITED from the ALREADY EXISTING FOUNDATION, (AND THE STILL EVOLVING greatness of America), built on the backs of many ENSLAVED AFRICANS, who's descendants are TODAY STILL CONSIDERED SECOND-CLASS CITIZENS IN THE LAND THEIR ANCESTORS HELPED TO BUILD AND ELEVATE (including fighting in the war of independence, and as part of Lincoln's Union-Preserving Army between 1860-1865)- which was partly why having Harriet Taubman, who worked to free many slaves and LED MILITARY EXPEDITIONS DURING THE CIVIL WAR, be given a spot on one side of the $20 Bill, WASN'T A PARTICULARLY EXCESSIVE OR UNREASONABLE ASK. Because, like it or not, THE ORIGINAL African Americans, DESCENDED FROM ENSLAVED AFRICANS, are part of the very fabric of this great nation.

OBTUSE LAWMAKERS will do well to remember this as they currently effusively cater only to the well-heeled, while abstaining from making the country more inclusive and equal, by failing, in the long arc of history, to pass such edifying and mutually beneficial LAWS OF GENERAL APPLICATION like the one proposed by THE GREAT JOHN LEWIS (of blessed memory). YES, HISTORY REMEMBERS .....

FOR THE TIME-BEING (and hopefully for the foreseeable future), THIS GREAT NATION WILL REMAIN PART OF THE LAW'S EMPIRE. SO, FOR THE SAKE OF BETTER NATIONAL COHESION, ENDURING GREATNESS, AND SEAMLESS NATION-BUILDING, (where they hope their descendants too will proudly thrive), OUR LEADERS (including lawmakers at all levels across the country) SHOULD WAKE UP TO THE FACT THAT THE CURRENT SHORT-SIGHTED HYPER-TRIBAL APPROACH IN A CONSTITUTIONAL REPUBLIC PREDICATED ON THE RULE OF LAW, IS ULTIMATELY NOT SUSTAINABLE IF IT MEANS TO GROW AND CONTINUE TO FLOURISH AND TO REMAKE ITSELF. The only evidence you need are some otherwise successful homogeneous societies now at or nearing the brink of carelessly self-imposed population 'immolation" by short-sighted and arrogant politicians- almost reminiscent of this current season of anomie.

Anyway, back to the general discussion on the law and how to leverage it effectively. By adopting the key strategies outlined above, individuals can empower themselves to smartly leverage the law in various situations. Legal literacy not only facilitates better decision-making but also fosters a sense of security and confidence in navigating the legal landscape. Ours is an open society guided by the rule of law. So, here as in many open societies similarly deemed part of "The Law's Empire" will have a wealth of accessible resources in this regard unlike places where the law aligns with the mood of the leader, or what some (civilian or military) dictator arbitrarily says it is. Accessing and utilizing these legal resources will ultimately lead to improved outcomes and a fortified position in any legal context.
